Famyuni terms of use

These terms of use, referred to as the “Terms”, define the rules for accessing famyuni.com and the Famyuni Android application. They set out the rights and commitments of the publisher and users in the context of family help organised within groups.

1 Publisher and contact

Famyuni is published by Nicolas VIGNY in a personal capacity, residing at 16 rue Olympe de Gouges, 25000 Besançon, France.

In these Terms, “I” refers to the publisher of Famyuni and “you” refers to the person using the service. The legal notice provides additional information about the publisher and hosting.

2 Purpose of the service and free access

Famyuni is a free platform that helps families organise support for a loved one, share useful information and make each person’s contribution visible, while respecting everyone’s abilities. Access to the features is free, with no subscription or commission charged by Famyuni.

Balance indicators serve as points of reference. They create no debt, remuneration, claim or obligation to provide financial support. Famyuni does not replace discussions between loved ones or the qualified professionals who support them.

3 Acceptance and duration

The Terms are made available to you before account creation. Access to members-only features requires their acceptance through an explicit action.

The relationship governing use of the service is entered into for an indefinite period, until the account is closed or the service ends under the conditions below. An invitation to join a group does not constitute acceptance on behalf of its recipient.

4 Access from age 15 and capacity

Account creation is restricted to people aged at least 15. An account created below this age may be closed after verification; a report alone is insufficient to establish a false declaration.

A minor or their legal representative may contact the publisher for an explanation or to report a difficulty.

5 Account creation and security

The account is personal. You provide accurate information, an email address you can access and a confidential password.

You must not impersonate another person or use their account without authorisation. Each member uses their own access credentials, including within the same family. Notify me promptly if you lose control of your account or notice suspicious use.

You take reasonable precautions to protect your access credentials and log out of a shared device.

6 Groups and collective decisions

A group brings together family members and, where applicable, trusted guests. Creating a group does not, in itself, give its creator general decision-making power over other members.

Family members participate in contributions, balance and decisions according to their rights. Trusted guests only view content to which they have been granted access; they do not participate in balance calculations, support or collective votes.

Changes subject to collective approval, including certain customisations and contribution capacities, require the agreement of all eligible voters concerned. A refusal prevents them from being applied. Open consultations collect opinions and do not automatically change these settings.

Only share invitation links and QR codes with the intended people. No vote or group rule may impose an unlawful obligation, infringe a person’s rights or provide consent on their behalf.

7 Contributions and planning

You report contributions in good faith, with dates, durations, distances and expenses that are as accurate as possible. When an entry concerns another member, you ensure that they are informed and can request a correction. An entry does not constitute independent verification by Famyuni.

A planned contribution describes intended help. It must only enter the help group’s balance calculation once validated as completed. The scheduled date being reached does not, on its own, demonstrate that the help took place. Each occurrence in a series must correspond to an actual completed action.

A group member may request that a contribution reported by another member be frozen, according to the conditions and deadlines displayed in the service. They state the reason for the request. The contribution remains visible in the group history, marked as frozen, but is excluded from balance calculations while the freeze remains in effect. Freezing does not mean Famyuni has established that the contribution is false.

The contribution’s author is informed of the freeze and can discuss it with the member who requested it; the member who froze the contribution can unfreeze it, after which it is counted again according to the applicable rules. If the disagreement continues, it remains frozen and excluded from calculations. Famyuni does not resolve family disputes about whether help actually occurred, but may intervene when use violates these Terms.

If you can no longer provide planned help, you inform those concerned and, where available, use the features for withdrawing or making the help available to the group again.

The possibilities for editing, deleting and disputing depend on the role, the contribution’s status and the service’s time limits. In the event of an error or disagreement, contact those concerned.

8 Balance

Balance takes into account the recorded data, the relevant period, contribution capacities and confirmed support.

This reference does not measure a person’s worth or all the help they provide. An unrecorded contribution, an error, a change or a member’s departure may change the results.

Balance does not represent money, a redeemable credit or a right to receive payment. An amount shown as a guide does not set a price for work and does not turn family help into a professional service.

9 Support between members

Support is voluntary. It may take the forms offered by the service, including help, a service, lending or giving an item, or reported financial support. Everyone remains free to offer, refuse or take no further action, without any balance indicator creating an obligation to participate.

Help and any money transfers take place outside Famyuni. In the operation described by these Terms, the publisher does not receive or hold funds and does not execute any payments for members.

Reported support must be confirmed by its recipient to be included in confirmed balance. A pending offer or request is not proof of completion. The recorded confirmation expresses the recipient’s declaration; it is not a bank certification.

Those concerned agree directly on the arrangements for their support and keep any useful supporting documents.

10 Shared content and respect for people

You remain responsible for texts, images, documents, contact details and other information you add or share. You must hold the necessary rights or authorisations and respect the privacy of those concerned, including people without an account.

You limit information to what is needed for mutual help. Sharing within a group does not make content public or permit its unrestricted reuse. You do not share another member’s private information externally without a valid basis or appropriate authorisation.

In particular, the following are prohibited within the service:

  • Threats, harassment, discriminatory remarks, unlawful content and pressure intended to obtain help or payment.
  • Deliberately false declarations, identity theft and unauthorised access to data or a group.
  • Publishing content that infringes copyright, image rights, confidentiality or minors’ rights.
  • Malware, attempts to bypass protections, unauthorised bulk extraction and uses that disrupt the service.

A member’s or guest’s role gives them no authority to legally bind another person. Family arrangements remain subject to respect for that person’s wishes.

Members may enter information strictly useful for organising help for a person being supported, even if that person has no Famyuni account. They take care to respect the person’s privacy and, where possible, inform them of the group’s existence in a way appropriate to their situation. They avoid publishing sensitive information unnecessary for mutual help. A group’s existence does not give its members the right to decide on behalf of the person supported or to freely share their health information.

11 Intellectual property and use of content

Famyuni elements protected by intellectual property rights, including texts, visuals, distinctive signs and software, remain the property of their rights holders. These Terms grant you a personal, non-exclusive right to use the service for your mutual help needs for the duration of your access.

You retain the rights you hold in your own content. To enable its use in Famyuni, you authorise the publisher, free of charge and on a non-exclusive basis, to host, back up, technically reproduce and display it only to authorised people. Adaptations are limited to format and operational needs, such as resizing an image.

This authorisation applies solely to providing the service, for the lawful retention period of the content, in the locations where the providers described in the privacy policy operate. It does not permit use of your family content in advertising or transfer of its exploitation to a partner.

The deletion and retention of certain shared content are detailed in Article 15 and the privacy policy. Authors’ moral rights, third-party component licences and statutory exceptions remain respected.

12 Personal data and communications

The privacy policy describes the data used, its purposes, recipients and retention periods, and how to exercise your rights.

Famyuni may send you communications necessary for creating and securing your account and for operating the groups you participate in. The preferences available in your account allow you to adjust communications.

Depending on the separate choices you have made, Famyuni may email you its newsletter and, separately, information or offers from Famyuni partners. Partner-related messages are sent by Famyuni: your contact details are not passed on to Famyuni partners. You can withdraw your agreement at any time through your account preferences or the unsubscribe link in the relevant emails. Withdrawal does not affect your access to the service.

A person being supported, whether or not they have a Famyuni account, may exercise their rights concerning their personal data by writing to contact@famyuni.com. The privacy policy details how the request is handled. The right of access concerns personal data relating to the person making the request. A copy or extract may be provided where necessary to exercise that right, while respecting the rights and freedoms of others.

13 Technical access and availability

Use requires Internet access and a compatible browser or device. Some features may differ between the website and the application. Device permissions must match the features you wish to use.

I take reasonable measures to maintain the service and correct malfunctions. Interruptions may result from maintenance, updates or incidents. Foreseeable interventions that materially affect access are announced where possible; urgent action may be immediate.

Famyuni is not an emergency system, a medical monitoring system or a guaranteed alert system. For an emergency or help that is essential on a specific date, contact the relevant people or services directly. A notification or planned entry does not guarantee that it has been seen.

Famyuni is currently offered as a test version. I personally develop and manage this project. Despite the checks and fixes I perform, some features may contain errors, slowdowns or interruptions. By using this version, you are informed of this possibility, and I invite you to report any difficulty, even a minor one, to contact@famyuni.com or through the “Contact” feature in “My account”. Your reports help me improve the service. The test phase does not reduce your statutory rights or my obligations, particularly regarding security and data protection.

14 Reports and restrictions

You can report content or behaviour by email to contact@famyuni.com or, if you have an account, through “Contact” in “My account”. A person without an account can submit a report by email. Specify its location or details that help identify it, the reasons for the report and a way to reply to you. Send only necessary supporting evidence, without unnecessarily disclosing family data.

I examine reports diligently. Depending on the seriousness and the information available, I may request a correction, limit the visibility of content, remove it or suspend the access concerned. These measures must be justified, necessary and proportionate.

Except in an emergency, a risk to a person, a security breach or a legal prohibition, the user concerned is informed and can submit observations before a significant restriction. Famyuni’s decision and its main reasons are communicated to them, subject to information that must remain protected.

An affected person may request a review of a decision to remove content, restrict access, suspend or close an account, by email to contact@famyuni.com or through “Contact” in “My account” when they still have access. They identify the disputed decision and the information they wish to bring to my attention. Their request is examined as soon as possible and a reasoned response is provided. If account access is suspended or closed, the email route remains available. This process does not deprive them of other legal remedies.

The Famyuni community rules, accessible before account creation and at any time through the service, form part of the usage rules you accept with these Terms. In particular, they explain the behaviour expected within groups. In the event of non-compliance, I may take the measures provided for in this Article, depending on the seriousness of the situation and in accordance with the procedure described.

15 Leaving and closing an account

You can leave a group without deleting your account, or request deletion of your Famyuni account. Uninstalling the application does neither of these things.

If you leave a group that still has other members, you lose access to that group and its new information. Your contributions and content necessary to understand its history may remain visible to group members, labelled “Former member”. Your identity is hidden in the interface, but this content is not necessarily anonymous: its context may allow you to be recognised. Famyuni retains the link needed to restore your previous contributions if you rejoin the same group with your account.

If you are the last member to leave a group, the group and its associated data are deleted. Famyuni does not retain closed groups for later reopening.

If you delete your account, you lose access to Famyuni and data linked to your account is deleted as detailed in the privacy policy. In groups where other members remain, your past contributions may be kept to preserve the group’s history, labelled “Former member”, after deletion of the technical link tying them to your account. If you later create a new account, even with the same email address, these contributions are not reassigned to you. If you were the last member of a group, that group and its data are deleted.

The label “Former member” does not guarantee that content is anonymous. You can request examination of a text, photo, document or other information that still allows you to be identified. I handle the request in accordance with the rights described in the privacy policy, taking into account, where appropriate, the rights of others concerned.

I may close an account in the event of a serious or repeated breach, or where required by law, service security or the protection of people. The safeguards in Article 14 apply.

If the service permanently ends, I inform members with reasonable notice, except in an emergency or where there is a legitimate inability to do so. Where possible, I explain how and within what period they can retrieve content to which they are entitled before it is deleted.

16 Responsibilities

Each party is responsible for its breaches in accordance with applicable law. In particular, the publisher is responsible for obligations relating to security, data protection and provision of the service.

Members are responsible for their declarations, content and actions. The publisher does not guarantee that help will be provided, that support will be received or that information it cannot verify is accurate. The publisher remains responsible for its own breaches.

17 Changes to the service and the Terms

I may develop the service to correct issues, improve security, adapt its features or comply with a legal obligation. Significant changes affecting members’ rights or commitments are explained and announced with reasonable notice, except where urgency requires otherwise.

A substantial change to the contract requires renewed acceptance where necessary; it does not apply retroactively. Simply publishing new text does not, by itself, constitute your agreement. You may refuse the new conditions and end your use according to the announced arrangements.

No subscription, integrated payment or new fee may be imposed solely because you continue using the service. Any potential paid offer must be subject to separate information and agreement.

18 Applicable law and dispute resolution

These Terms are governed by French law, subject to mandatory protections available to you, including in your country of residence where applicable.

If you encounter a difficulty, you may submit a complaint to contact@famyuni.com. An amicable solution may be sought without depriving you of your remedies. If no resolution is reached, the competent courts are determined by law.
